Privacy Policy

1. Introduction

  1. Website Owner. iGo Marketing and Entertainment ("iGo") is the owner of www.thewhiskyx.com, www.thetequilax.com, and www.premierspiritsgroup.com (“Websites"). iGo can be contacted by mail at 201 Montauk Highway, Westhampton Beach, NY 11978, by e-mail at support@igomark.com. This online privacy notice discloses iGo information practices for Websites, including what type of personal identifiable information is requested in order to make a purchase, how the information is used, and with whom the information is shared. Note that other iGo Websites may be governed by privacy notices containing different information practices applicable to those sites.

  2. Anonymous Website Visits. In general, you can visit Websites without disclosing or revealing any personal information. iGo does keep track of the domains from which people visit us for informational and marketing purposes.

  3. Website Transactions. At times, iGo will need personal information regarding a customer or a prospect. For example, to process an order or provide a subscription, iGo may need to know a customer's name, mailing address, e-mail address and credit card details. It is iGo's intent to inform you before iGo collects personal information, such as user's name and/or address on the Internet. If you tell us that you do not wish to have this information used as a basis for further contact with you, iGo will respect your wishes.

  4. Information Provided from Outside the United States. iGo Websites are hosted in the United States. Accordingly, by submitting any personal information to iGo or through any of iGo’s entities, or entering any sweepstakes, promotional activities, or purchasing tickets, products, or services on Websites you are transferring your personal information to the United States, and you consent to such transfer. iGo also abides by the Privacy Shield framework as set forth by the United States Department of Commerce regarding the collection, use and retention of information collected from the customers from European Union.

2. Personal Information That May Be Collected

  1. Identifying Information. In order to make a purchase or to access designated subscriber services and/or restricted areas within the Websites, iGo will request a user to provide certain personal identifying information, which may include: legal name, postal address, e-mail address, user name and password, telephone number, method of payment, and, if applicable, credit card number. iGo may request additional information necessary to establish and maintain customer's account.

  2. Service Quality Monitoring. Some Website transactions may require a customer to telephone iGo, or iGo to call the customer. iGo will not contact you by telephone without your prior consent, except to confirm an order placed online and/or to inform a customer of the status of such order. Customer should be aware that it is iGo's practice to monitor, and in some cases record such calls for staff training or quality assurance purposes.

  3. Personal Data collected via Cookies. We may use your Personal Data for our marketing and advertising purposes, including (without limitation) by email, SMS marketing, display media, and targeting other devices (such as tablets, mobile devices, and televisions). We do this in order to inform you about services or events we believe might be of interest to you, develop promotional or marketing materials and display event-related content and advertising that we believe might be of interest to you.   4. Information from Children. You must be twenty-one (21) years of age or older to access Websites. iGo does not market or sell products or services for purchase by children, and will not collect or post information from any person under the age of 21. iGo will delete any account discovered to have been created by a person under the age of 21.

  5. Lost or Stolen Information. If a customer's password or credit card information is lost or stolen, the customer should promptly notify iGo in order to enable iGo to cancel the lost or stolen information and to update its records with a changed password or credit card.

  6. Social Media Sites. If customer participates in any iGo social media outlets, customer should be aware that the information disclosed and shared will be broadly available to other persons, both inside of and/or outside iGo, who have access to the same social media outlets. Additionally, when you “like” or “follow” us on Facebook, Instagram, X, or social media sites (to the extent we provide that capability), we may collect some information from you including your name, email address, and any comments or content you post relevant to us. We likewise may collect your information if you sign up for one of our promotions or submit information to us through social media sites. Some individual social media outlets have additional rules and conditions regarding participation. Also, participant's expressed opinion is his or her own and should not be considered as reflecting the opinion of iGo.

  7. Links to Other Websites. An iGo Website may contain links to other Websites. iGo is not responsible for the privacy practices or the content of those other Websites.

3. Disclosure of the Information

  1. Within Corporate Organization. iGo is not currently a multinational organization, with legal entities, business processes, management structures, and technical systems that cross borders. However, if an event is produced in any other country other than the United States, iGo may share your personal information within the iGo corporate organization, and may transfer the information to countries in the world where iGo conducts business. Some countries may provide less legal protection for customer personal information. In such countries iGo will still handle customer personal information in the manner describe herein.

  2. Mergers and Acquisitions. Circumstances may arise where for business reasons, iGo decides to sell, buy, merge or otherwise reorganize its businesses in the United States or some other country. Such a transaction may involve the disclosure of personal identifying information to prospective or actual purchasers, and/or receiving such information from sellers. It is iGo's practice to seek appropriate protection for information in these types of transactions.

  3. Agents. iGo employs or engages other companies and individuals to perform business functions on behalf of iGo. These persons are provided with personal identifying information required to perform their functions but are prohibited by contract from using the information for other purposes. These persons engage in a variety of functions which include, but are not limited to, fulfilling orders, delivering packages, removing repetitive information from customer lists, analyzing data, providing marketing assistance, processing credit card payments, and providing customer services.

  4. Affiliated Businesses. iGo works closely with affiliated businesses operating Website stores, providing services or selling products on each other's Websites. These businesses identify themselves to customers. Customer information related to a transaction with an affiliated business is shared with that affiliated business.

  5. Marketing Analysis by Third Parties. iGo reserves the right to disclose to third parties, personal information about customers for marketing analysis; however, any information disclosed will be in the form of aggregate data that does not describe or identify an individual customer.

  6. Disclosure to Governmental Authorities. Under certain circumstances, personal information may be subject to disclosure pursuant to judicial or other government subpoenas, warrants or orders.

4. Use of Computer Tracking Technologies

  1. Use of Cookies. iGo, or its third-party vendors, collects non-identifiable and personal information through the use of various technologies, including "cookies". A cookie is an alphanumeric identifier that a Website can transfer to customer's hard drive through customer's browser. The cookie is then stored on customer's computer as an anonymous tag that identifies the customer's computer, but not the customer. Cookies may be sent by iGo or its third party vendors. Customer can set its browser to notify a customer before a cookie is received, giving an opportunity to decide whether to accept the cookie. Customer may also set their browser to turn off cookies; however, some Websites may not then work properly.

  2. Use of Web Beacon Technologies. iGo may also use Web beacon or other technologies to better tailor its Websites to provide better customer service. If these technologies are in use, when a visitor accesses these pages of the Website, a non-identifiable notice of that visit is generated which may be processed by iGo or by its suppliers. Web beacons usually work in conjunction with cookies. If customer does not want cookie information to be associated with customer's visits to these pages, customer can set its browser to turn off cookies; however, Web beacon and other technologies will still detect visits to these pages, but the notices they generate cannot be associated with other non-identifiable cookie information and are disregarded.

  3. Collection of Non-Identifiable Information. iGo may collect non-identifiable information from user visits to the iGo Websites in order to provide better customer service. Examples of such collecting include: traffic analysis, such as tracking of the domains from which users visit, or tracking numbers of visitors; measuring visitor activity on iGo Websites; Website and system administration; user analysis; and business decision making. Such information is sometimes known as "clickstream data." iGo or its contractors may use this data to analyze trends and statistics.

  4. Collection of Personal Information. iGo collects personal identifying information from customer during a transaction. This information is used to confirm the transaction and provide information and updates on the upcoming events. Customers cannot opt out of this communication. iGo may also extract some personally identifying information about that transaction in a non-identifiable format and combine it with other non-identifiable information, such as clickstream data. This information is used and analyzed only at an aggregate level to help iGo understand trends and patterns. This information is not reviewed at an individual level.

5. iGo, WhiskyX, TequilaX, and Premier Spirits Group Marketing

  1. The Use of Cookies and Personal Data. iGo may use your Personal Data, in compliance with CAN-SPAM, for our marketing and advertising purposes, including (without limitation) by email, SMS marketing, display media, and targeting other devices (such as tablets, mobile devices and televisions). We do this in order to inform you about services or events we believe might be of interest to you, develop promotional or marketing materials, and display event-related content and advertising that we believe might be of interest to you.   2. Stored Information Uses. iGo stores and retains the information entered on the Websites. This information is used to compile a customer's purchase history in order to enable us to recommend products, services, or special offers that would be of interest to a customer.

  3. Online Advertising. Some companies that help iGo deliver interactive on-line advertising, such as banner ads, may collect and use information about iGo's customers to help iGo better understand the types of advertising or promotions that are most appealing to iGo's customers. After it is collected the information is aggregated so it is not identifiable to a specific individual. If, however, customer would prefer that these companies not collect such information, please mark an "X" on the opt-out option box provided.

  4. Opt Out from Electronic Communications. At any time, you have the option to “unsubscribe” or “opt-out” of email communications by clicking on the “unsubscribe” link at the bottom of each marketing email. Alternately, you can email us at support@igomark.com to request being removed from the email marketing list.

6. Information Security

  1. Commitment to Online Security. iGo employs physical, electronic, and managerial procedures to safeguard the security and integrity of personal information. Billing and payment data is encrypted whenever transmitted or received online. Personal information is accessible only by staff designated to handle online requests or complaints. All iGo agents and contractors with access to personal information on the iGo Websites are also bound to adhere to iGo’s security standards.

  2. No Liability for Acts of Third Parties. iGo will exercise all reasonable efforts to safeguard the confidentiality of customer personal information. However, transmissions protected by industry standard security technology and implemented by human beings cannot be made absolutely secure. Consequently, iGo shall not be liable for unauthorized disclosure of personal information due to no fault of iGo including, but not limited to, errors in transmission and unauthorized acts of iGo staff and/or third parties.

7. Privacy Policy Changes and Opt-Out Rights

  1. Changes to Privacy Policy. This privacy notice was last updated on September 1, 2023. iGo reserves the right to change or update its privacy policy statement at any time. A notice of any material change will be posted on the iGo Website home page for thirty (30) days prior to the implementation of such change. There will be two boxes at the end of iGo's notice of change (1) an "I accept" box, and (2) an "I do not accept" box. If customer does not mark the "I do not accept" box customer will {be deemed to} have accepted iGo's privacy policy updates.

  2. Opt-Out Right. Customer and/or prospective customer have the right at any time to cease permitting personal information to be collected, used or disclosed by iGo and/or by any third parties with whom iGo has shared and/or transferred such personal information. Right of cancellation may be exercised by contacting iGo via e-mail at support@igomark.com. After processing the cancellation, iGo will delete customer or prospective customer's personal information from its data base. Please allow 48 hours to process your request.

8. Access Rights to Data

  1. Information Maintained by iGo. Upon customer's request, iGo will provide a reasonable description of customer's personally identifiable information that iGo maintains in its data bank. iGo can be contacted by e-mail at support@igomark.com.

  2. Corrections and Changes to Personal Information. Help iGo to keep customer personal information accurate. If customer's personal information changes, or if customer notes an error upon review of customer information that iGo has on file, please promptly e-mail iGo at support@igomark.com and provide the new or correct information.

  3. Your California Privacy Rights. Beginning on January 1, 2005, California Civil Code Section 1798.83 permits customers of iGo who are California residents, to request certain information regarding iGo’s disclosure of personal information for their direct marketing purposes. To make such a request, please write to: iGo Marketing and Entertainment at 201 Montauk Highway, Westhampton Beach, NY 11978. Within 30 days of receiving such a request, iGo will provide a list of the categories of personal information disclosed to third parties for third-party direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of these third parties. This request may be made no more than once per calendar year. iGo reserves the right not to respond to requests submitted other than to the address specified in this paragraph.
    California’s privacy laws require a company to provide notice to California users of their rights to receive information on to which entities their information was shared for marketing purposes.

9. Accountability

  1. Questions, Problems and Complaints. If you have a question about this policy statement, or a complaint about iGo compliance with this privacy policy, you may contact iGo by e-mail at support@igomark.com. If iGo is unable to resolve your complaint to your reasonable satisfaction or if customer does not receive acknowledgment of an inquiry, customer may elect to proceed by contacting the Data Privacy Framework Program.

  2. Alternative Dispute Resolution. If a dispute arises out of or relates to this privacy policy, or the breach thereof, and if the dispute cannot be settled through good faith negotiation, the parties agree first to try in good faith to settle the dispute by mediation administered by the American Arbitration Association under its Commercial Mediation Procedures before resorting to arbitration, litigation, or some other dispute resolution procedure. Each Party shall pay their own costs and fees. The Parties, in agreement with this sub-part of this Agreement, waive any rights they may have to a jury trial in regard to arbitral claims.

  3. Terms of Use. If customer chooses purchase tickets, products, or special membership or to subscribe to iGo services, customer's action is hereby deemed acceptance of iGo practices described in this policy statement. Any dispute over privacy between customer and iGo is subject to the provisions of this notice and to iGo's Terms of Use Agreement which is hereby incorporated herein and which can be read at www.thewhiskyx.com, www.thetequilax.com, and www.premierspiritsgroup.com.
